An indeterminate life sentence, another indeterminate life sentence to be served consecutively. 65 years in enhancements. All determinate terms. Eligible for parole after 25 years of minimum time served on each life sentence. Life sentence starts in 2056 or until eligible parole date of 2081.
Statement of Case
I was accused of raping and sodomizing my wife on January 30 1997. This alleged crime was a domestic violence case. My wife Gina R Baker and I had separated on numerous occasions, the last time we separated was in January of 1997 - prior to this incident. I was served a temporary restraining order and subsequently evicted from the home we shared with our two young children. The night before we came to be together, I spoke with my wife at her work place, and again at her home - that was on January 29 1997. We engaged in consensual sexual intercourse at my new residence, where she became very upset with me (as she always did) and snatched up our infant child and stormed out of the room. My wife broke the restraining order - not I. We agreed to meet at the home we once shared to discuss our marriage, taxes, child care and visiting arrangements for the children. We agreed to meet at 11am/11.30am. I waited outside the house for her, when she came home she told me to go around to the back side so she could let me in without our neighbor, Jennifer, seeing me. We engaged in sexual intercourse in the living room, then again in the master bedroom. We began to argue again about everything so I told her I was not going to do this ever again. I asked her 'what do we do now? do we remain separated, get a divorce, or stay married'? She stated 'you just can't leave good enough alone', I said 'what was so good about what we just did, you just used me for sex again and I'm done'! She got upset and pulled out a black handled steak knife and came at me with it. I tried to take the knife from her but during the struggle she fell into the closet and was badly injured by the knife. I saw what happened and started to administer first aid in order to stop the bleeding. I tried to call 911 but the phone was out of air-time. I heard a loud knock at the door, it was the security police - I panicked and ran out the back door.
I had filed for divorce On January 22 1997, and had her served with the papers on January 24 1997 by one of her immediate supervisors. She obtained a temporary restraining order after I served her with the divorce papers. Every weekend I would go to the home we once shared she would get upset because I would not succumb to her many demands. When the security police arrived sometimes they would ask me to leave, and other times they would request that my wife leave and allow me to remain with our children, as there was no violence or threats of violence ever in my past. The restraining order was a ruse to keep me out of our home.
