Sentenced To Forty (40) Years (All Mandatory)
I was an Emergency Medical Services Captain and reserve Police Officer prior to my arrest. I was also highly active in my community and volunteered with many charities. However, during a confrontation in 2001 I shot a man. Thankfully, he survived. I was falsely accused of robbing and beating the man after the shooting. A juvenile co-defendant done that; I DID NOT. However, I confessed to police regarding all accusations to protect the juvenile and they released him.
In court, the prosecutor lied to the judge and told him no-one else was ever accused. He also falsely told the judge that I'd parole after 10 years no matter what sentence he gave me. Despite my being a first time offender I was given 40 years. The prosecutor indeed lied to the judge about me paroling after 10 years. State law prohibits my parole at all. The judge thought I'd parole in 2011 and be on parole for 30 years but, as things stand now, I will remain in prison until 2041.
